1. Acceptance of Terms

By downloading, installing, or using the Arc Business Card Scanner application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and Arc Automated ("we," "our," or "us").

2. Description of Service

Arc Business Card Scanner is a mobile application designed to help users scan business cards, extract contact information, manage contacts, and integrate with third-party CRM systems such as GoHighLevel. The App also provides features for sending SMS messages, making calls, and emailing contacts directly from your device.

3. User Responsibilities

Acceptable Use

• Lawful Use: You agree to use the App only for lawful purposes and in compliance with all applicable local, state, national, and international laws.
• Data Accuracy: You are responsible for verifying the accuracy of the contact information extracted from business cards before saving or using it.
• Communication Consent: If you use the App to send SMS messages, emails, or make calls, you are solely responsible for obtaining any necessary consent from the recipients in compliance with applicable laws (e.g., TCPA, CAN-SPAM).

Prohibited Activities

• Using the App to send unsolicited communications (spam).
• Attempting to reverse-engineer, decompile, or hack the App.
• Using the App to systematically scrape or collect data unlawfully.
• Selling, renting, or leasing elements of the App without authorization.

4. Third-Party Services and Integrations

GoHighLevel Integration

• The App allows integration with GoHighLevel and other potential CRM systems.
• This integration requires you to provide your own valid API credentials.
• We do not control and are not responsible for the performance, security, or data handling practices of any third-party services you connect to the App.

Device Functionality

• The App interacts with your device's camera, contacts, and SMS functionalities. You grant us permission to access these features solely for the purpose of providing the App's core services as described in our Privacy Policy.

5. Privacy and Data Security

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data. By using the App, you consent to the data practices outlined in our Privacy Policy.

6. Intellectual Property Rights

Our Ownership

The App, including its code, design, features, and functionality, is owned by Arc Automated and is protected by copyright, trademark, and other intellectual property laws.

Your License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal or internal business purposes, subject to these Terms.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE APP, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR PERFECTLY ACCURATE AT EXTRACTING TEXT FROM ALL BUSINESS CARDS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARC AUTOMATED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON OR RELATED TO THE APP.

9. Modifications to the App and Terms

We reserve the right to modify or discontinue the App (or any part thereof) with or without notice. We may also update these Terms from time to time. Your continued use of the App following any changes indicates your acceptance of the new Terms.

10. Subscriptions and Billing (Terms of Use / EULA)

These Terms also constitute the Terms of Use (EULA) for Arc Business Card Scanner when distributed through Apple’s App Store. Access to the App is provided on a subscription basis.

Subscription Details

• Title of service: Arc Business Card Scanner Full Access (auto-renewable subscription).
• Length of subscription: Monthly (1 month).
• Price: The subscription price is displayed in the App Store and at the time of purchase and may vary by region and currency.
• What you get: Full access to the App’s features during an active subscription period, including business card scanning, contact management, sharing, follow-up tools, and related functionality offered in the App.

Payment, Renewal, and Cancellation

• Payment will be charged to your Apple ID account at confirmation of purchase.
• The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription price.
• You can manage your subscription and turn off auto-renewal by going to your Apple ID Account Settings after purchase (Settings → Apple ID → Subscriptions, or App Store account subscriptions).
• Deleting the App does not cancel your subscription. You must cancel through your Apple ID subscription settings.

Free Trial

If a free trial is offered, any unused portion of a free trial period will be forfeited when you purchase a subscription to that service, where applicable. After the free trial ends, the subscription renews automatically unless cancelled at least 24 hours before the trial ends.

Refunds

Subscriptions purchased through the App Store are subject to Apple’s payment and refund policies. To request a refund, contact Apple Support or use Apple’s Report a Problem process.

These Terms of Service / Terms of Use (EULA) are effective as of the date listed above and apply to all users of the Arc Business Card Scanner app.
